The scientific article is devoted to highlighting the issue of the peculiarities of the pre-trial investigation of criminal offenses provided for in Article 409 of the Criminal Code of Ukraine, which consist in evasion of military personnel from military service by self-mutilation, simulation of illness, submission of forged documents or direct refusal to perform military duties.

The article examines the legal status of a defense attorney in criminal proceedings, particularly their role during searches and temporary access to items. Searches and the seizure of evidence represent one of the most intrusive interferences with citizens’ rights; therefore, the participation of a defense attorney ensures compliance with the law and prevents violations of individual rights.

The article examines the illegal handling of poisonous or potent drugs, which poses a danger to the health of the population, since the uncontrolled circulation of such items threatens an indefinite circle of participants in social relations. The article defines the tactical tasks of the investigation of criminal offenses and the algorithm for conducting such investigative (search) action as a search.
