Hierarchical Structure as a Characteristic of a Criminal Organization

Abstract. Criminal organizations are complex and structured entities that operate within society with the aim of engaging in illegal activities and generating profits through criminal means. One of the key characteristics of such organizations is their hierarchical structure, which plays a significant role in the functioning and sustainability of these groups. It allows for the efficient distribution of tasks, the control of members' activities, and ensures the organization's long-term operation despite external threats.

On the question of criminal organization as a form of compatibility

The article is devoted to the characterization of a criminal organization as a form of complicity.

Organized crime is a negative social phenomenon that is caused by social relations that arise as a result of human activity.

In the current Criminal Code of Ukraine, the criminal organization has found expression as the most dangerous form. The need to define this form of complicity, its typical and specific features is caused primarily by the rapid growth of organized crime. 

Objective signs of complicity in a criminal offense

The article is devoted to the analysis of objective signs of complicity in a criminal offense.

Objective signs of syphoning are characterized by: a) kilkic sign; b) a yakic sign; c) a single wrongful deduction for all spying students; d) a causal link between the spitting speakers and a single opposite result. The remaining two signs are indispensable for criminal offenses with a material warehouse.

Classification of forms of participation in crime

The article is devoted to the analysis of the question of classification of forms of complicity in crime. It is stated that modern criminal law is quite far from solving the question of a unified approach to the classification of forms of complicity. The current Criminal Code of Ukraine was not able to completely remove the said dispute.
