In the article features of legal maintenance of functioning of the social state are considered. The necessity of concretising the definition of the concept "social state" is substantiated. The analysis of normative and legal acts regulating social security issues was carried out and it was proposed to develop and to adopt the Law of Ukraine "On Social Security" by taking into account the peculiarities of existing threats.
In the process of building society model of legal relations of public institutions with public becomes more bilateral (dialogue) character, but still remains asymmetric in terms of protection of national interests, the emphasis in this model is still biased towards the interests of the authorities to prioritize the interests of citizens, creating a series of obvious barriers to
establishing these relationships. Updated rethink this model of communication and symetryzatsiyi towards balancing public interests with the interests of the state.
