The article examines the main directions of influence of international, in particular, European human rights standards as necessary legal prerequisites for Ukraine's accession to the European Union. International human rights standards currently serve as the basis for introducing the best achievements of humanity in the state and legal sphere into the legislation of Ukraine. With the beginning of the full-scale invasion of Ukraine by the Russian Federation, the institutions of the European Union decided to open negotiations with our state on Ukraine's membership in this international formation. Ukraine officially received the status of a candidate for membership in this international association on June 23, 2022.
Based on an analysis of modern domestic scientific legal literature, the article highlights the main approaches to understanding the general theoretical concept, features and functions of international human rights standards, and, in particular, the features of European standards of such rights.
Іn the process of research, it was found that modern international human rights standards, in particular, European standards of such rights, in addition to determining certain classical directions of influence on the transformation of the legislation of modern states (such as, for example, a) determining the list of human rights and freedoms that must be recognized by the states-participants of a particular convention; b) formulating the content of rights and freedoms that must be embodied in the constitutions and laws of the states-participants of a certain international act; 3) fixing restrictions and prohibitions related to the implementation of human rights and freedoms), now also perform certain new functions in international and national legal systems.
It has been established that such new directions of influence of the above-mentioned standards should include the establishment of criteria for the legality of acts, decisions and actions not only of the structural elements of the mechanism of a certain state, but, which is no less important today: a) determining the criteria for the legality of acts, decisions and actions of bodies and institutions of certain international formations, in particular the European Union; b) forming common legal principles for the protection of human rights in the context of the interaction of regional systems for the protection of human rights.
