Розглянуто основні історичні етапи становлення поглядів на систему стримувань і противаг. Виокремлено основні характеристики кожного з історичних періодів дослідження зазначеної проблематики. Відстежено еволюцію основних ідей щодо поділу влади та показано зміст системи стримувань і противаг як основної запоруки демократичного функціонування влади за умов республіканської форми правління. Виокремлено характерні особливості системи стримувань і противаг на практиці сучасних демократій.

This article is devoted to the problem of the nature of the state, which is relevant both in theoretical and in practical terms, and linked to the needs of research nature of the state as a category of philosophy and jurisprudence, the analysis of patterns of relationship development and functioning of the state and its entities.

The article analyzes the constitutional-legal status of the heads of governments of European countries mixed republican form of government. Attention is paid to the order of appointment, functions and powers of the heads of governments of European mixed republics. It has been illustrated the scientists’ opinions of the functioning the head of government in certain countries.
