Досліджується вплив римського права та Constitutio Criminalis Carolina на формування кримінально-правових норм у володіннях Габсбурзької монархії XVIII століття. Наголошується на тому, що вивчення цієї проблеми має ключове значення для розуміння еволюції правової системи монархії Габсбургів, а також є актуальним з огляду на потребу розуміння джерел сучасних кримінально-правових норм, їх історичних основ та правових традицій, що їх сформували.

Based on analysis of the fundamental values of Roman law that reflected and embodied in many national legal systems of Western Europe, reveals characteristics of the formation of the concepts of these systems. It was found that borrowing ideas and provisions of the Roman law was carried out through its basic principles, namely cosmopolitism, multiculturalism, fairness and individualism. Found that spirit, idea, principles of Roman law had a positive effect on the national legal system.
