This article explores the legal nature of sexual war crimes in the context of armed conflict, particularly with reference to the ongoing war in Ukraine. It emphasizes the systematic use of sexual violence as a tool of terror, repression, humiliation, and the destruction of social structures. The article examines the compliance of such acts with international humanitarian law.
У статті здійснено аналіз місця та ролі міжнародних інституцій у процесі правосуддя пе- рехідного періоду. Визначено, що концепція правосуддя перехідного періоду є системою механізмів та інструментів, що запроваджуються у певній країні, яка перебуває в стані переходу від збройного конфлікту до пост-конфліктного періоду або від тоталітарного до демократичного режиму.
The article deals with questions of the International Criminal Court in the context of
counteraction to aggression. Based on the methodology of system analysis of international and
national legislation, the realization of the competence of the Rome Statute of the International
Criminal Court concerning aggression and the impact of the legal practice of the institution on
security is explored. The addition of the term “aggression” is proposed by new factors
associated with the emergence of cyber-attacks and other new means.
