The article justifies the need to improve the institution of detention of a suspect in criminal proceedings in Ukraine. This is due to the need to implement European standards, which are set out in the European Convention on Human Rights and implemented in the practice of the European Court of Human Rights.
The issue of compliance with national standards ensuring an individual’s right to protection in accordance with international standards has been considered. It is noted that one of the primary tasks of modern international law is to ensure international protection of human rights and establish norms regulating relations between states and other subjects of international law. These norms aim to guarantee the rights and freedoms of individuals as provided by international agreements.
The article is devoted to the issue of interest to scientists and practitioners in the context of the application of a precautionary measure in the form of a personal guarantee — a description of the guarantor's personality as trustworthy. The study of the provisions of current legislation and the results of the scientific work of scientists has reasonably allowed us to draw appropriate conclusions.
It was revealed that the appointment of a forensic psychiatric examination in criminal
proceedings. The basic questions of forensic psychiatric examination of the suspect in the
murder were determined. The analysis of expert researches of the socio-psychological
component of the characteristics of the killer person is carried out.
The article examines the question of the suspect wanted in criminal proceedings in the context of certain aspects of international cooperation, regulated by international treaties and international legal acts recognized by Ukraine. We give the definition and types of international cooperation in criminal proceedings, and noted that international arrest suspects accused in the Interpol system – is part of international cooperation among States in combating crime.
