The article states that with the beginning of the full-scale invasion of the Russian Federation to Ukraine more than two and a half years have passed. During this time, law enforcement agencies initiated 127,814 criminal proceedings under various articles of the Criminal Code of Ukraine. It should be noted that many of them have already been examined by domestic courts and those guilty of criminal offenses have been held criminally liable.

The article analyzes the sphere of application for Article 3 of the European Convention for the Protection of Human Rights and Fundamental Freedoms. Based on the decisions of the European Court of Human Rights, the distinction between the concepts of torture and inhuman treatment has been researched. Attention is drawn to the absolute character of Article 3 of the Convention, regardless of circumstances or situations.
