The article is devoted to defining the main constituent elements of an effective legal mechanism for the implementation of legal responsibility for crimes against the environment in the context of the full-scale military aggression of the Russian Federation against Ukraine.
The current system of liability in the field of investment activity is considered in the article. It is proved that the legal institute of liability is an obligatory element of the mechanism of legal regulation of investment relations, as it directs the actions of all subjects of investment activity to lawful behavior.
The author examines the legal responsibility, which is inextricably linked with the need to comply with regulations, rules of conduct, submission, harmonization of their behavior with the objective laws of nature and society. If there is no need to comply with any rules, regulations, then there is no responsibility. Legal requirements are formulated in the form of legal obligations in the form of specific or general legal relations.
The article deals with the types of responsibility for violation of rights in the field of intellectual property. The peculiarities of administrative responsibility concerning the violation of intellectual property rights are investigated. Also, there are indications of legal liability for violations in the field of intellectual property.
The article deals with the modern approaches to the formation of the institution of responsibility of the state to a person. The author made an attempt to analyze the relationship “person – state” in the field of implementation of the rights and freedoms of man and citizen. It is proved that one of the reason of the irresponsibility of the state in this context is the absence of effective mechanisms of realization of such responsibility.
