Доступність суду, як елемент правової держави, відіграє вагому роль у реалізації права громадян на справедливий суд. В сучасних умовах потрібно проана­лізувати основні бар’єри, які можуть обмежувати участь громадськості у судочинстві. Аргумен­товано, що усунення таких бар’єрів може сприяти активніше звертатися до суду по захист законних прав та інтересів, залучати громадськість до участі у судочинстві як через безпосередню участь у судовому розгляді, так і через інститути громадського контролю.

Анотація. У статті проведено аналіз історико-правових та новітніх глобалізаційних тенденцій розвитку принципу участі громадськості як фактору відкритості судової влади.

Констатовано, що відкрите урядування гарантує прозорість, підзвітність і відкритість влади, одночасно збільшуючи можливості участі громадян. Доведено його затребуваність при реалізації судової влади.
