Ukrainian constitutionalism in the conditions of war: the struggle for values, rights and identity

Abstracts. The article provides a comprehensive analysis of the functioning mechanism of the constitutional legal order under martial law, in particular the means and methods by which it can protect constitutional values, rights and identity from internal and external threats, and also offers practical recommendations for preventing the possible involution of constitutionalism in the post-war period. 

Ukrainian national statehood, Ukrainian constitutionalism, state-legal tradition

The phenomenon of constitutionalism and the Ukrainian model of constitutionalism in the context of the formation of the national state-legal tradition is researched. The opinion is that the main formula for the existence of the Ukrainian model of constitutionalism is the idea of ensuring human rights and freedoms through the restriction of state power, in the first place, by means of parliamentary, local self-government and the organization of state relations with a clear division of powers.

Ukrainian constitutionalism as public law practice: the times of “the first UPR’’

We study the Ukrainian constitutionalism as state-legal practice of UPR during the
period of the Ukrainian Central Rada. It is noted that the state-legal practice of “The first
UNR” is based on constitutional law, the development of which was relied on the concept of
law. The advantage of constitutional law acts in the Ukrainian Central Council is stipulated by
the need to provide the public policy of democratic orientation.

Ukrainian organic constitutionalism: the period of “the second UNR”

Ukrainian constitutionalism – constitutional law and constitutional and legal research in
Ukraine during the period of Directory or “The Second UPR is studied.” It is noted that the
UPR Directory constitutional law determines the general thrust of its legislative activity, and
attempts to create its own coherent constitutional act was caused also by the need of providing
the public policy of democratic orientation

The origins of constitutional ideology of the Ukrainian state formation as the national one

We study the origins of constitutional ideology of the Ukrainian state formation as the national one. It is emphasized that the foundations of this ideology in Ukraine was founded in the middle of the XVII century, when on conditions of National Revolution of the Ukrainian people, the necessity of the development of the former Ukrainian national state as an independent, and mainly, sovereign was justified. It is emphasized that the attempt to introduce monarchism was caused by the need of external legitimization of the State.
