This article is devoted to the influence of the institution of the presidency on the formation of Ukrainian statehood. The article determines the status and role of the President during the existence of independent Ukraine and analyzes historical aspects of the formation of the institution of the presidency.
There are analyzed the theoretical foundations of the issue of constituent power and the possibility of its practical implementation in terms of constitutional reform in Ukraine, including the possible adoption of a new Constitution of Ukraine. According to the author, adoption of a new Fundamental Law of Ukraine by popular election of the Constitutional Assembly could contribute to the growth in the society the authority of the Constitution, establishment of political stability in the country and restore public confidence in the government.
The questions of research methodology phenomenon constitutional reform. The possibilities of use of dialectic, axiological and activity approaches in the study of constitutional reform. The attention to the importance of using historical (historical and legal) method and the value of systematic, structural and functional, legal-dogmatic, comparative legal methods of knowledge of constitutional reform. We prove the rationality of the use of an integrated approach to the study of the phenomenon of constitutional reform.
This article is devoted to the problematic issues of the new Constitution of Ukraine drafting at the present stage of social relations development. The analysis of the draft of the Law of Ukraine “On the procedure of the new Constitution of Ukraine drafting” dated January 14, 2016 number 3781, which regulates the process of initiation, development and approval of the draft of the new Constitution of Ukraine.
