The basics of the notarial process in Ukraine, in particular scientific views and modern approaches to the problem of legal definition of the notarial process, features of notarial proceedings for certification of contracts are investigated in the article.
Thus, the author determined that the notarial process means the activities of notarial bodies carried out in the manner prescribed by law.
The article deals with the vital questions of legal regulation of notarial activities in Ukraine. The concept of notary powers is one of the central issues of notarial activities in any of the member states of the International Union of Latin Notaries. The author performs a comparative analysis of the powers of notaries in Georgia and Ukraine. Notary bodies of both Georgia and Ukraine are called upon to protect the subjective rights and legitimate interests of individuals and legal entities that apply to them for making notarial acts.
The article is devoted to investigation of issues about rights and duties of notary according to the current legislation, determining of possibility of committing by him one or the other acts and expediency of conveying to him some powers by state. A measure of permitted behavior of a notary is determined in the article, and system of bans in his activity is established.
