Abstract. The article clarifies the influence of the religious factor on the formation of the legal ideology of Ukrainian society in modern realities, which often has an ambiguous and contradictory character in the formation of the newest mechanism for the realization of human and citizen rights and freedoms.
The article characterizes the peculiarities of the functioning of judicial bodies as subjects of the system of administrative and legal guarantee of the activity of religious organizations in Ukraine. Implementation by judicial bodies of administrative and legal guarantees of the activities of religious organizations is carried out by the system of courts of general jurisdiction, administrative courts, and the Supreme Court of Ukraine, acting on the same basis, regarding the implementation of joint tasks in the sphere of justice.

The article carries out a theoretical and legal study of religious organizations as participants in the discourse of the concept of human rights, clarification of the peculiarities of their perception of human rights in the historical context. It is proved that the contribution of Western and Eastern religious organizations to the development of the concept of human rights is not homologous.

The article summarizes scientific views on the concept of administrative and legal guarantees of volunteer activity of religious organizations in Ukraine, identifies the problems of formation and implementation of these guarantees.
The article analyzes the administrative and legal guarantees of higher spiritual education in the context of modern educational legislation of Ukraine. Given the insufficient level of scientific and legal study of the topic and innovative processes in the Ukrainian educational environment, our article fills the gaps in the study of this issue to some extent. Despite the declared norms in the educational legislation, administrative and legal guarantees of the activity of higher spiritual education institutions as religious organizations continue to be formed.
