Age discrimination outside the labor sphere

The purpose of the article is to analyze the legal policy in the field of combating age discrimination outside the labor sphere. Research methods are a complex of philosophical methods (in particular, dialectical and hermeneutic), general scientific (comparative, historical, analysis and synthesis) and special scientific methods (comparative legal and practice research methods). Results: the inadequacy of the legal policy of Ukraine and a number of European states regarding the restriction of people's rights as a factor in ensuring public health has been proven. Discussion: on the basis of current international and national normative legal acts and the actualization of the problems considered in them, the peculiarities of legal policy in the field of age non-discrimination outside the sphere of work are indicated.

It is indicated that the use of chronological age as the only criterion for measures of physical isolation and continued forced deprivation of the right to movement is discriminatory, as it does not take into account the very diverse capabilities and needs of the elderly. Such measures can increase the risks of social isolation and loneliness, limit older people's self-care capabilities and challenge the responsiveness of the health and social care system to older people's existing medical and social needs, which may ultimately have detrimental health effects. and the well-being of the elderly.
