Адміністративно-правове забезпечення реалізації громадянами права на житло в Україні

В статті розглянуто питання, пов’язані з адміністративно-правовим забезпеченням регулювання відносин у житловій сфері та умовах реалізації громадянами України права на житло. Особливу увагу приділено аналізу положень закріплених в Конституції України (ст. 47) щодо права кожного громадянина на житло, а також роль держави в реалізації цього права шляхом створення умов: для побудови житла, для придбання житла у власність, для користування житлом у вигляді оренди [1].

З урахуванням військової агресії російської федерації та України (з 24.02.2022 р.) питання забезпечення житлом громадян, що вимушено залишили місця постійного проживання набули надзвичайно важливого значення. Заходи забезпечення житлом цієї категорії громадян потребують нового за змістом адміністративно-правового регулювання з метою їх активної реалізації.

Актуальною за змістом є думка Т. В. Шаповалової, яка аналізуючи добробут населення серед показників якісної оцінки рівня життя та його добробуту виділяє його житлові умови, наявність яких є однією з людських потреб і свідчить про рівень життя людини [2 с. 52-53].

Проведено аналіз дотримання принципів і реалізації завдань закріплених у Житловому кодексі України, (далі – ЖК України), Кодексі України про адміністративні правопорушення (далі – КУпАП), Законі України «Про загально державну програму реформування житлово-комунального господарства на 2009 - 2014 роки», Законі України «Про житлово-комунальні послуги» та інші нормативно-правові акти, що покликані регулювати відносини у житловій сфері.
