The article examines the problems of argumentative practice in legal activity. The emphasis is placed on studying the requirements for speakers as subjects of the judicial process. The factors influencing the effectiveness of argumentation are determined, namely: communication skills and abilities, knowledge, ideas, the value system of the speaker, emotional and psychological state, social status and role in society. The influence of these factors on determining the tactics and strategy of argumentation and selection of arguments is indicated. The macrostructure of argumentative discourse, the basic elements of which are thesis, argument and demonstration, is studied, the essence and functions of each of them are considered. The features of such types of speech as monologue and dialogue are clarified. The specifics and requirements for the effectiveness of their use, the conditions under which they should be applied, are determined. The importance of preliminary preparation of arguments and monologues and dialogue separately on the effectiveness of argumentation is revealed. The significance of logic and emotional and psychological methods of persuading subjects of the judicial process is clarified. The necessity of their comprehensive application to improve the effectiveness of argumentation, advantages and disadvantages of each of them are determined. Differences between legal and scientific evidence in accordance with their characteristics are revealed. The specifics of applying the concepts of "legal argumentation" and "legal argumentation" to cover all factors related to argumentation practice are studied. The range of questions and arguments they cover is clarified. The expediency of their application in accordance with the peculiarities of argumentative practice is determined. The influence of positivist and anthropocentric paradigms on the formation and development of argumentative practice and the conditions under which it can function is revealed. The advantages and disadvantages of each of them are clarified. The significance of the ideas of applying logic and general modeling theory to the formation of a favorable environment for the evolution of argumentative discourse in court proceedings is studied.
