The article examines the issues of financial and legal support in Ukraine under the conditions of the armed aggression by the Russian Federation. It focuses on the transformation of legal mechanisms for the formation and use of state financial resources, as well as on the adaptation of the public finance system to the conditions of martial law.
It has been noted that financial and legal regulation in wartime has undergone signi-ficant changes, particularly in the areas of the budget process, taxation, government borro-wing, and international financial assistance.
It has been proven that the provisions of regulatory legal acts of the Verkhovna Rada of Ukraine, the President of Ukraine, the Cabinet of Ministers of Ukraine, central public admi-nistration bodies, regulations of the National Bank of Ukraine, and international legal agree-ments on the provision of financial support aimed at stabilizing the economy have become important legal forms of financial support.
It is substantiated that the main directions of implementing financial and legal support are the organizational and legal regulation of the process of uninterrupted budget financing of the security and defense sectors, the social sphere, support for economic stability, trans-parency and accountability in the use of financial resources, as well as interaction with inter-national financial institutions.
The main problems in the field of financial and legal regulation have been identified, including the imbalance between budget revenues and expenditures, the risks of misuse of funds, legal uncertainty regarding the procedure for international grant inflows, and imper-fections in control and auditing under wartime conditions. The paper proposes ways to impro-ve the legal mechanisms of financial support based on the principles of transparency, accoun-tability, and sustainability.
It has been proven that the need to finance the defense sector and guarantee social stability against the backdrop of a sharp reduction in the tax base (due to the destruction of the economy, migration, and loss of control over territories) has caused an imbalance that cannot be covered by domestic resources.
In view of the identified problems, taking into account the principles of transparency, responsibility and sustainability, in order to increase the stability of the financial and legal support of Ukraine, it is proposed to develop and adopt the Law of Ukraine “On Financial and Legal Support for Post-War Economic Recovery in Ukraine”, with a focus on increasing the efficiency of the public sector of the economy, further creating a clear legal framework for the targeted use of special recovery funds.
The study results are of practical importance for improving the effectiveness of Ukraine’s financial and legal policy in the context of martial law and post-war economic recovery.
