The Criminal Procedure Code of Ukraine distinguishes between investigative (investigative) and covert investigative (investigative) actions. It is to covert investigative actions - interference in private communication. Communication is the transmission of information in any form from one person to another directly or through any means of communication. The article is devoted to the problem of defining the concept, content and extent of interference in private life in criminal procedure law. Much attention is paid to the legal regulation of types of interference in private life and their features. Separate articles from the Constitution of Ukraine are subject to analysis. Among the list of human rights, which includes political, socio-economic and socio-cultural rights, a special place belongs to the protection of personal or private aspects of human life. The right to privacy or the right to respect for private life is guaranteed by a number of international documents and national legislation, so it is proposed to consider international legal acts that emphasize the conditions of interference in the above-mentioned sphere of rights. The right to secrecy of correspondence, telephone conversations, telegraph and other correspondence is a personal, intangible right that traditionally belongs to the basic natural human rights. Private life can be defined as a physical and spiritual sphere under the control of man himself, ie a sphere protected from external directed influence. It is the existence of private law that protects a person from any intrusion into his or her private life, such as listening in on telephone conversations, accessing his or her letters or messages, and disclosing their contents or the very fact of correspondence or conversation. It was emphasized that a fair balance must be taken into account in determining the obligations within the limits and modalities of interference with a person's private life. In view of the above, it is important to consider issues related to criminal procedural guarantees of individual rights and problems of their implementation in the criminal proceedings of Ukraine.
